2.To enter: This promotion begins at 1:00 pm (ET) on Thursday, August 28, 2008 and ends at 11:59 pm (ET) on Thursday, December 4, 2008 (“Entry Period”). There are two (2) ways to enter this promotion: Text Message Method: Open to all participating carriers. During the Entry Period, using your text-message enabled wireless phone, send the text message “VOTE” to short code 51234 to be automatically entered into the promotion. You may enter as many times as you wish. Upon receipt of your text message entry, you will be offered to participate in an additional interactive component (e.g. trivia, poll) and each response will be (1) additional entry. You do not have to respond, and for trivia, you will receive one (1) additional entry each time you respond whether you answer correctly or incorrectly. Normal charges will apply for text messaging based on your current messaging feature subscription. Text “STOP” to 51234 to quit. Online Method: You may also enter into the promotion by going to www.espnallamerica.com and following the instructions to submit online entries, including entering your name, contact phone number and email address. Your entry is deemed submitted upon receipt of your text message or your online transmission. Entries will be disqualified if they contain any inappropriate material or language, including profanity. Neither AT&T Mobility LLC (‘Sponsor’), American Broadcast Company (‘ABC’), Entertainment Sports Program Network (‘ESPN’), Career Sports & Entertainment, Inc. (‘CS&E’), or any of their employees, affiliates, subsidiaries, divisions, marketing agencies, nor any telephone network or service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, or any other error or malfunction, or late, lost, illegible or misdirected entries. Text message and online entrants must be the registered subscriber of the text message or online account by which their entry is made. In case of a dispute regarding identity of person submitting an electronic entry, the entry will be deemed submitted by the natural person who is the authorized holder of the transmitting e-mail address or text messaging device/service at the time of entry. Incomplete text message and online entries are void. By entering, entrants acknowledge compliance with these official rules, including all eligibility requirements. All entries become the property of the Sponsor.
3.Drawing: Winner will be determined in a random selection process to be conducted on or about Tuesday, December 9, 2008 by CS&E from all eligible text message and online entries received as outlined above. Sponsor and CS&E (collectively “Judges”) decisions on all matters relating to the promotion shall be final.
4.Prize: Grand Prize: One (1) grand prize winner will receive: (i) round-trip coach airfare for two (2) from a major commercial airport near winner’s home to a major commercial airport near Miami, FL (“Airport”) (specific airport locations to be determined by Sponsor based on availability); (ii) two (2) tickets to the college football championship game on Thursday, January 8, 2009 in Miami, FL (“Game”); (iii) 3-day, 2-night hotel accommodations (double occupancy) in the vicinity of the Game (“Hotel”) from Wednesday, January 7, 2009 through Friday, January 9, 2009; (iv) ground transportation to/from Airport and Hotel; (v) ground transportation to/from Hotel and Game; and (vii) Five Hundred and NO/100 Dollars ($500) (ARV: $4,100). All travel expenses and incidentals not specified herein shall be the sole responsibility of the winner. Prizes are non-transferable. No substitution of prizes permitted; however, Sponsor reserves the right to substitute any prize with another of equal or greater value. All prizes will be awarded. Odds of winning depend on the number of eligible entries received.
5.Determination of Winner: Winner and guest must sign and return any required Affidavits of Eligibility/Release of Liability/Prize Acceptance forms and IRS-W9 forms within three (3) days of receipt. Non-compliance will result in disqualification, and Sponsor or CS&E may select an alternate winner. By entry into this promotion, winner consents to the use of his/her name and/or photograph for promotional purposes without additional compensation (except in TN or wherever else prohibited by law).
6.Eligibility: Promotion open only to legal residents of the United States who are 18 years of age or older. Employees of Sponsor, ABC, ESPN, CS&E, their affiliates, subsidiaries, divisions, advertising and promotion agencies and the immediate families of each are not eligible. Sponsor reserves the right to verify eligibility qualifications of any winner. Income or other taxes on any prizes awarded are the responsibility of the winner.
7.General Conditions. If for any reason the promotion is not capable of running as planned, whether due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the promotion, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion. In the event of termination, a random drawing to award the prizes will be conducted from all eligible entries received up until the time of termination. Should the promotion be terminated, Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications network failure, theft or destruction of or unauthorized access to, or alteration of entries. Sponsor is not responsible for any problems or technical malfunction of any wireless or wired telephone network, computer online systems, service providers, computer equipment, software, failure of any entry to be received by Sponsor on account of technical problems, human error or traffic congestion on any telephone or internet connection or at any website or any combination thereof, including any injury or damage to entrants or any other person’s computer related to or resulting from participation or downloading any materials in this promotion. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Should the promotion be terminated prior to the stated expiration date, notice will posted at www.espnallamerica.com. The Sponsor is not responsible for typographical errors in any promotion related material. If by reason of any error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question.
